1. Acceptance of Terms
By accessing or using the COH platform, website, or mobile applications (collectively, the “Platform”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not access or use the Platform. We reserve the right to modify these Terms at any time, and your continued use of the Platform constitutes acceptance of any changes.
2. Description of Services
COH provides an online marketplace that connects guests seeking to book spaces and experiences by the hour with hosts who offer such spaces and experiences. COH is not a party to any agreement between hosts and guests and does not own, operate, or manage any listed spaces or experiences. COH acts solely as an intermediary platform facilitating connections between hosts and guests.
3. Account Registration
To access certain features of the Platform, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for safeguarding your account credentials and for all activity that occurs under your account. You must notify COH immediately of any unauthorized use of your account.
4. Bookings
When you book a space or experience through COH, you enter into an agreement directly with the host. COH facilitates the booking process, including payment processing, but is not responsible for the quality, safety, or legality of listed spaces or experiences. Guests are expected to treat spaces with care and respect all house rules set by hosts.
5. Payments
A $5 booking platform fee is charged when a reservation is made. The room rate and any applicable taxes are paid directly to the hotel at check-in. The $5 booking fee is fully refundable if the booking is cancelled or in the event of a no-show. All prices are displayed in USD at the time of booking.
6. Cancellations and Refunds
All bookings on Couple of Hours come with free cancellation. You can cancel any booking at any time before check-in. The $5 booking platform fee is fully refunded upon cancellation or no-show. Please review our Cancellation Policy page for detailed information.
7. Limitation of Liability
To the maximum extent permitted by law, COH shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Platform. COH's total liability for any claim arising from your use of the Platform shall not exceed the amount of fees you paid to COH in the twelve months preceding the claim. This limitation applies regardless of the theory of liability.
8. SMS / Text Messaging
Couple of Hours offers an SMS messaging program for transactional notifications related to your account and bookings. By providing your phone number and opting in, you may receive text messages including verification codes, booking confirmations, cancellation notices, check-in updates, and support ticket notifications. Message frequency varies based on your activity. Standard message and data rates may apply. Consent to receive SMS is not a condition of purchase. You can opt out at any time by replying STOP to any message. Reply HELP for help or contact us at support@coupleofhours.com. 9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved through binding arbitration in San Francisco, California, in accordance with the rules of the American Arbitration Association. You agree to waive any right to a jury trial or to participate in a class action.
